McGuinness is accused of sexually a*saulting the woman inside a Claremont Ave.apartment early Thursday after his pal, who also hails from the Emerald Isle, first had sex with her.
The trio and another woman had gone from a bar to the other woman’s apartment, prosecutors said.
«What started out as a consensual encounter between the defendant’s friend and the complaining witness ended with the defendant raping [her],» Assistant District Attorney John Temple told a Manhattan judge.
The prosecutor said the woman reported the 4:45 a.m.attack immediately after McGuinness and his buddy left and told cops the duo had thick Irish accents.
McGuinness, who has lived in Queens for about a year, and his pal, Brian Duddy, 24, were busted on a nearby subway platform at 5:20 a.m.when cops heard them yakking away in their distinctive accents, police sources said.
The 22-year-old woman told cops that Duddy had sex with her and then held her down while McGuinness violated her, police sources said.Duddy was arrested, but the charges were later dropped, leading to his release, officials said.
Prosecutors declined to comment on why the charges against Duddy were dropped.
«[Duddy] told detectives that anything that transpired was consensual and that he was the only other witness to the incident,» McGuinness’ public defender, Brad Sage, told Manhattan Criminal Court Judge Anthony Ferrara.
Police sources said the trio and the other woman, who lives in the apartment, returned together from an East Side bar.The victim and Duddy then went to bed together, and McGuinness joined them at some point.
The attack happened after the other woman had gone into another room, cop sources said.
Prosecutors asked for $25,000 bail, but the judge ordered McGuinness held on $5,000.
When the judge asked him to surrender his pa*sport, McGuinness said he’d lost the document along with his license.
